The website https://glassworks.io/ (hereinafter: "the Website") is operated by Glassworks Optics Ltd., Company No. 515876472 (hereinafter: "the Operator"), which has a store at: 41 Nachalat Binyamin St., Tel Aviv (hereinafter: "the Store").
The Website serves as a platform for the sale of optical products and eyewear, and also includes informational, marketing, and other content in the field of optics and/or the Operator's business.
These terms apply to all devices on which the Website is displayed - mobile phone, tablet, television, computer, etc.
These terms are written in masculine form for convenience only, and all provisions apply equally to all genders.
In addition to reading these Website Terms, it is mandatory to read the Cancellation, Shipping, and Warranty Policy.
The provisions of these terms apply to all use of the Website. Browsing the Website, including placing an order or any other action through it, constitutes the user's consent to these terms and to act accordingly.
Use of the Website constitutes a declaration that the user has read these terms, understood them, and accepts them. The user waives any claim or demand against the Operator and/or anyone on its behalf, except for claims relating to breach of the Operator's obligations under these terms and in accordance with the law.
A user who does not agree to the terms/provisions of these terms and the Website is requested not to use the Website and certainly not to make a purchase.
The Operator may update the terms of use from time to time, at its sole discretion, without the need for prior notice or warning. Any change will take effect from the moment of its publication on the Website, and use of the Website after publication will constitute the user's consent to the updated terms. It is recommended to review the terms from time to time before using the Website.
The Operator strives to maintain continuous maintenance and full availability of the Website. However, there may occasionally be updates, changes, or temporary shutdowns - some due to maintenance and improvement needs and some due to factors beyond the Operator's control. The Operator may, at any time and at its sole discretion, stop or suspend the Website's operation, in whole or in part, and update, change, or correct its nature and content, without prior notice.
Prices displayed on the Website may differ from prices at the Operator's physical store. The binding price for a purchase made on the Website is the price displayed on the Website at the time of placing and confirming the order. Prices at the physical store will apply only to purchases made at the store.
The user agrees that the Operator's/Website's system data, computerized information, and data will constitute prima facie evidence of the correctness of actions performed on the Website, and are admissible in any legal proceeding without the need for additional evidence from the Operator.
Use of the Website and its content is provided "AS IS" and is intended for personal and private use only. Any attempt to change, interfere, manipulate, disrupt, or adapt the Website, its content, or operation in any way is strictly prohibited.
Any use of the Website and/or any content from it for any commercial purpose is strictly prohibited without prior written approval from the Company.
The user declares and undertakes to use the Website only in accordance with the law and the conditions set in these terms by the Operator.
The Website and/or Operator may assign their rights under these terms of use to third parties, as they see fit, without the need for prior notice and/or publication on the Website.
Any waiver of any of the above conditions shall not be considered a continuing waiver of that condition or any other condition.

These terms shall be governed by the laws of the State of Israel. The competent court in the city of Tel Aviv shall have exclusive jurisdiction to adjudicate any dispute between the parties in connection with this agreement and/or arising from it.

Intellectual Property

All intellectual property rights in the Website and all its content belong to the Operator and/or the relevant rights holders on its behalf. Including: copyrights, registered and unregistered trademarks, trade names, patents, designs, trade secrets, databases, product lists, product descriptions, product designs, prices, technical specifications, graphics, images, photographs, videos, source code and object code, applications, software, computer files, graphic design, color schemes, Website structure, domain, icons, logos, and any other content related to the Website's operation.
The user is strictly prohibited from copying, duplicating, restoring, transmitting, publishing, distributing, selling, marketing, renting, transferring to third parties, sublicensing, editing, changing, translating, creating derivative works, publicly displaying, publicly performing, commercializing, or exploiting in any other way the Website's content, in whole or in part, in any media - unless explicit prior written permission has been given by the Operator.
Reverse engineering, disassembly, reverse compilation, or attempts to disrupt or change the source code are strictly prohibited on the Website or its systems.
Operating any computer application or technological means (including Crawlers, Robots, Spiders, Scrapers, or any similar tool) for searching, scanning, collecting information, or automatic copying of Website content is prohibited.
Displaying content from the Website in any way is prohibited, including through iframe or any other embedding mechanism, visible or hidden, that changes or detracts from the Website's design or content.
Using any information from the Website (including prices, information, videos, images, and product descriptions) for establishing a comparative or competing website/platform or any other commercial activity is prohibited without explicit prior written permission from the Operator.
If you have been harmed by publication of an image or have not received proper credit - please contact the Website Operator immediately with the relevant image and a reasoned explanation.

Privacy Policy

The Operator respects the privacy of Website users and considers privacy protection a supreme value.
The Operator makes every effort to protect user privacy and safeguard information provided by the user. However, there may be malfunctions and/or failures including and/or force majeure events and/or arising from reasons not attributable to the Website Operator and/or not under its control, and therefore the Website Operator shall have no liability to the user.
If you do not agree with one or more of the terms of use, you are requested to leave the Website, not to make any use of it or the services offered on it, and not to purchase products/services.
If you wish to purchase a product/service from the Website, you will be asked to provide personal details. These details, as well as additional non-personal information that will be accumulated about the customer, will be stored in the Website's database. If you do not wish certain information to be stored about you, you are requested not to provide personal details and/or not to use the Website's services.

The Website reserves the right to change or update the privacy policy at any time, at its sole discretion, and without prior notice. It is recommended to review the privacy policy from time to time to stay updated on changes. Continued use of the Website after any change constitutes consent to the updated privacy policy.

Product Purchases

A customer meeting all of the following cumulative conditions is entitled to place an order on the Website: a) is legally competent to perform binding legal actions (and if under 18 years of age or incompetent - written approval from a parent or other guardian is required); b) holds a valid Israeli ID card or valid foreign passport or is an entity legally incorporated in Israel; c) holds a valid credit card issued by one of the credit card companies recognized and approved/accepted by the Operator and/or any other payment method accepted on the Website at the time of purchase; d) has an active email address and a postal delivery address in Israel.
It is mandatory to provide correct and accurate details. It is clarified that details of identification or payment methods of a third party must not be provided.
Placing an order on the Website is done by adding products to the shopping cart, filling in shipping and payment details, and confirming the order in the Website's systems. The Operator may require additional verification of the user's details and/or payment method, at its discretion.
An order will be considered approved and binding only after the Operator has provided explicit confirmation by email to a valid email address provided by the user, and after approval of charge has been received from the credit card company or other payment method.
The Operator reserves the right to refuse to approve an order for any reason, including but not limited to: lack of stock availability, error in product details or price, suspicion of fraud, or failure to comply with the terms. In case of such refusal, notice will be sent to the user and a full refund of any amount actually paid will be made.
For the avoidance of doubt, in case of typographical error, typing error, technical malfunction, system error, or error in displaying the price or product description on the Website - this shall not bind the Operator, and the Operator shall be entitled to cancel the order and make a full refund of any amount actually paid.
Prices displayed on the Website include value added tax (VAT) as required by law and are quoted in New Israeli Shekels (NIS). The Operator may update prices from time to time without prior notice; however, price changes will not apply to orders that have already been duly approved.
Payment will be made via valid credit cards, PayPal, or any other payment method that the Operator may allow from time to time, at its discretion. The payment method will be charged only after the Operator has actually approved the order.
If payment is made by credit card - it will be charged in one payment and subject to the credit card company's terms - unless there was an explicit option to divide the payment into installments on the Website.
Shipping fees may be added to the product price as detailed in the order process. Shipping fees are determined according to the delivery destination, package weight, and additional logistical conditions as published on the Website - under the Cancellation, Shipping, and Warranty Policy.
The Operator may, at its sole discretion, offer promotions, benefits, coupons, or discounts on the Website. The terms of the benefit, including its start date and validity, will be determined and published on the Website and will bind users accordingly. The Operator reserves the right to change or discontinue any promotion, discount, or coupon at any time, even before its declared end date, without prior notice.
The Operator makes reasonable efforts to update product availability on the Website, but this does not guarantee that every product displayed on the Website actually exists in stock. It is emphasized that some products are luxury, unique, custom-designed, and/or created by designers, and therefore may be offered in limited quantities or by special order only. In case of stock depletion after placing an order, the Operator will notify the buyer and refund in full any amount paid.
The Operator may cancel any order, in whole or in part, in case of stock depletion, typographical error, error in price or product details, technical malfunction, or any other circumstance that prevents proper fulfillment of the order. In case of such cancellation, the full amount actually paid will be refunded to the buyer, and they shall have no further claim or demand against the Operator.

The Operator, its managers, employees, and those acting on its behalf shall not bear any responsibility for direct, indirect, consequential, special, or punitive damage caused to the user or any third party in connection with the use of the Website or products, except for the obligation to refund to the user/buyer the amount actually paid for the product subject to the order. In any case, the Operator's maximum and absolute liability shall not exceed the cost of the product as actually paid by the buyer.
The Operator may operate and send identification files (Cookies) to the user for the purpose of identifying the computer or device from which the connection to the Website is made, and may use information collected through them. For further details, the user is referred to the Operator's Privacy Policy.
It is clarified that use of the Website may be made without a personal user account, and therefore saving of "bookmarks" and shopping cart content is done through Cookies installed on the user's computer or mobile device.
While browsing the Website, the user can bookmark products of interest or add products to the shopping cart for future purchase.
If the user prevents use of cookies, deletes them, or turns off the computer/device - the information may be lost, including shopping cart content and bookmarked products. In such case, the user shall have no claim or demand against the Operator for loss of information or loss of purchase opportunity.
The Operator may perform statistical and analytical analyses regarding the information collected (such as the number of users who showed interest in certain products or added products to the shopping cart), and use it for marketing purposes, including displaying similar products, complementary products, or personalized offers. The user acknowledges that such activities may generate monetary profit for the Operator, and shall have no claim or demand against the Operator in this regard.
